Terms of Service

1. Service Description

Elevate is a workout tracking application for iOS and Apple Watch. The App allows you to log workouts, track progress, view heart rate data, connect with friends, and manage fitness programs. The App is provided "as is" and may be updated, modified, or discontinued at our discretion.

2. Accounts

You may use basic features without an account. To access social features and cloud sync, you must create an account using Sign in with Apple. You are responsible for maintaining the security of your account. You must be at least 13 years old to use the App, and at least 18 years old to purchase a subscription.

3. Free and Pro Tiers

Elevate offers a free tier and a paid subscription tier (Elevate Pro):

• Free: Core workout tracking, 3 programs, 30-day history, basic social features, Apple Watch heart rate display.
• Elevate Pro: Unlimited programs, full workout history, advanced progress charts, advanced heart rate analytics, program export/import.

4. Subscriptions and Billing

Elevate Pro is available as an auto-renewable subscription:

• Monthly: $5.99 USD per month
• Yearly: $34.99 USD per year

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. No refunds are provided for partial subscription periods, except as required by applicable law or Apple's refund policies.

5. Your Content

You retain ownership of all workout data, notes, and other content you create in the App. By using social features, you grant us a limited license to display your workout status (exercise names, active/inactive status) to your approved friends within the App.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Harass, abuse, or harm other users through social features
• Reverse engineer, decompile, or attempt to extract the source code of the App

7. Health Disclaimer

Elevate is a workout logging tool, not a medical device. Heart rate data, personal records, and any analytics provided are for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting or modifying any exercise program.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Lightbox Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Warranty Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting elevate@trainwithforge.fit. Upon deletion, your data will be removed from our servers within 30 days.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or by updating the effective date. Continued use of the App after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
